Does My Document Qualify for Online Notarization?

The short answer: the large majority of documents Floridians need notarized can be handled through Remote Online Notarization. Affidavits, powers of attorney, deeds, parental consent letters, bills of sale, sworn statements, and most real estate paperwork are all routinely completed online under Florida law. But there are exceptions, and they fall into two buckets.

Documents the law treats differently

Electronic wills are legal in Florida but carry extra statutory requirements — additional witnessing rules, qualified custodians, and specific execution formalities — so they need a real conversation before booking, not a same-day session. Testamentary trusts share that complexity. Documents headed outside the country can also be tricky: some foreign agencies and consulates will not accept an electronically notarized document even when Florida law makes it valid here.

Documents the receiving party won't take

This is the more common limit, and it surprises people: the law is rarely the obstacle. A lender, county recorder, employer, court, or foreign consulate can insist on an original wet-ink signature even where Florida fully permits an electronic one. Their preference controls, not the statute.

So before you book RON, ask the party who will receive the document one question: do you accept an electronically notarized PDF? One sentence in an email settles it and saves everyone a redo.

Practical considerations

Every signer in a RON session needs their own device, camera, microphone, and ID for identity proofing. When two or three signers are sitting in the same kitchen, a mobile appointment is usually faster than three separate video logins. And signers who are not comfortable with technology — or who lack the credit history that knowledge-based authentication draws from — are often better served in person.
