Five Notary Mistakes That Delay Documents

Rejected documents are rarely caused by anything dramatic. After enough appointments, you see the same five small, predictable problems send paperwork back — each one easy to prevent with ten minutes of checking beforehand.

1. Signing before the appointment

A notary must witness the signature, or in limited cases take your sworn acknowledgment that an existing signature is yours. Most receiving agencies insist on the witnessed version, which means a document that arrives already signed usually has to be reprinted and signed again. Resist the urge to sign at the kitchen table the night before — the signature line is the one line you fill in last.

2. Expired or mismatched identification

A license that expired last month is not acceptable identification, full stop. Just as common is a name mismatch: a document drawn in a maiden name cannot be matched to an ID showing a married name without supporting paperwork like a marriage certificate. Check both the expiration date and the exact name spelling before the appointment.

3. Blank spaces in the document

Notaries cannot notarize a document with empty fields that could change its meaning if someone filled them in later. Complete every blank, or mark it N/A. This one is pure prevention — a document with blanks is a document that can be altered after your signature is on it.

4. Missing or ineligible witnesses

Some Florida documents — deeds, certain powers of attorney, and many healthcare directives — require two witnesses in addition to the notary, and interested parties (anyone named in or benefiting from the document) generally cannot serve. Family members count as interested parties more often than people expect. Confirm the requirement in advance so the right people are in the room.

5. The wrong notarial certificate

An acknowledgment and a jurat are not interchangeable: an acknowledgment confirms you signed willingly, while a jurat requires you to swear or affirm the contents are true, signed in the notary's presence. The notary cannot choose for you — that would be practicing law — so ask the drafting attorney or the receiving agency which certificate your document requires before the appointment.
